Arbitration Complaint

An Arbitration Complaint is an alternative to litigation and attempts to resolve a real estate dispute that generally involves money.  A complaint must be filed with The Englewood Area Board of REALTORS® within 180 days after the closing of the transaction, if any, or within 180 days after the facts and circumstances constituting the arbitrable matter could have been known in the exercise of reasonable diligence, whichever is later.

It is advised that you become familiar with the Code of Ethics and Arbitration Manual, as it sets forth the rules used to process complaints. The arbitration hearing tribunal may provide legal and equitable relief to the parties; it does not, however, impose disciplinary action.  Also, the Board is not a governmental entity; therefore, it does not have authority to take action regarding the licensing status of its members.

To file an Arbitration Complaint, read and submit the following:

Please Note: There is a $500 filing fee for an arbitration.

If you have any questions regarding the filing of a complaint, please contact Dianne Clark at 941.474.6664 or via email.

Ethics

REALTORS® are different from non-member licensees in that they voluntarily subscribe to a strict Code of Ethics. If you believe that a REALTOR® has violated one or more Articles of the Code of Ethics, you can file an ethics complaint alleging a violation(s) through the local association of REALTORS® where the REALTOR® holds membership.

In addition, REALTORS® agree as a condition of membership to arbitrate contractual disputes and specific non-contractual disputes as provided for in Article 17 of the NAR Code of Ethics.

Frequently Asked Questions Questions and Answers Ethics Complaints

The first thing that must be determined in processing a complaint with the Englewood Area Board of REALTORS® (EABOR) is whether the real estate agent involved is a REALTOR® and a member of EABOR, or, receives MLS through EABOR. Not all real estate agents are REALTORS®. Only those who belong to an Association of REALTORS® can use the term REALTOR®. When joining an Association, all members agree to abide by the Code of Ethics as a continuing condition of membership. It is because of this obligation to abide by the Code of Ethics that you can file complaints at an Association of REALTORS®.
